C and an accomplice had sneaked onto D’s land, intending to steal from D’s shed. D an elderly man, had taken to sleeping in his shed with a shotgun. C tried to get into the shed and D shot him through the door. C sued for injuries to his neck and shoulder in Negligence and OLA.
D was guilty for negligence and “using violence in excess of the reasonable limits”
