  2. Establish code of conduct/boundaries
  3. Resolve disputes

What is the difference between criminal and civil disputes?

A

CRIMINAL

  • aim to punish and deter
  • case is brought into court by state or police
  • parties involved: accused, prosecutor
  • standard of proof: beyond reasonable doubt
  • burden of proof: prosecutor

CIVIL

  • aimed to protect people’s rights
  • case brought to court by plaintiff
  • parties involved: plaintiff, defendant
  • standard of proof: balance of probability
  • burden of proof: plaintiff

  • interpreted by a magistrate or police

NON-LEGAL RULES

  • all people rules apply to must obey
  • rules are made by leaders of that particular group
  • enforced by body/group in charge
  • interpreted by body/group in charge
