What is a declaratory judgment action?

A

A declaratory judgment is a court issued judgment that defines an outlines the rights and obligations of each party in a contract. They are final judgments and legally binding.
For example, in the case of insurance contracts, a declaratory judgment, help you determine a policy coverage. If a policyholder believes that their denied claim is unjust, they then informed the insurer that they are considering a lawsuit to recover losses. The insurer seeks a declaratory judgment, to clarify its rights, and obligations with hopes of preventing a lawsuit , if a judgment indicates the insurer is not obligated to cover the loss, the insurer will likely avoid litigation. If the judgment shows the insurer is responsible, then the policyholder is likely to sue the insurer to recover losses.

A

Amicus curiae means friend of the court. (FOC) They are briefs written by an individual or group not directly involved in the case. The purpose is to help the court determine custody parenting time, and child support issues. In addition, FOCs
1.helps parents settle disputes during and after their case.
2. Makes sure parents obey court orders
3. Provides court forms for some family law issues. A lawyer is not required to use these forms.
