Rule 8(a) pleading requirements
1) a short/plain statement of grounds for jurisdiction
2) a short/plain statement showing entitlement to relief
3) demand for relief
Notice pleading vs code pleading
Code pleading requires extensive detail of the case.
Notice pleading is just enough to let the defendant know what the suit is about. The rest comes out in discovery.
A response to a complaint must include…
1) response to the allegations (general and specific denials)
2) any affirmative defenses
*all elements must be addressed
General denial, specific denial, affirmative defense
General denial= objection to all aspects
Specific denial= denying allegations line by line
Affirmative defense= new information that would lead to reduction in liability.
