What is the purpose or intention of a PSO?
Used when you believe it is necessary to take action to ensure the safety of a person at risk and there is insufficient evidence to make an arrest.
After attending an incident and investigating the matter, what four options are available to police?
Take no further action
Issue a warning
Issue a PSO
Arrest where an offence has been disclosed and there is sufficient evidence
What is the maximum duration of a PSO?
5 Days
What effect does a PSO have on a ‘Parenting Order’ issued by the court?
Parenting orders are suspended for the duration of the PSO.
Who is defined as a ‘person at risk’?
The person named in the order
Any child residing with that person. (includes the children of the person the PSO is issued against)
Do police require the consent of a person at risk, in order to issue a PSO?
No (helps to avoid the person at risk being blamed for police action).
Who can issue a PSO?
A qualified Constable (SGT or above)
When police attend a domestic incident and make an arrest for a family violence offence, can a PSO be issued against the arrested person?
No, but you can ask for bail conditions which are similar to the PSO
How long after a PSO is issued does the bound person have to surrender any weapons, firearms or FLic?
Immediately.
When serving a PSO, what four things must be explained to both the bound person and the protected person?
Purpose of the order
Effect of the order
Duration of the order
Consequences of contravening the order.
How long can a person be detained for the purposes of issuing a PSO?

How long has do police have to serve a PSO, before it lapses?
