What is Section 7 of SASA?
Enter a place or vehicle to search for and arrest someone you suspect is unlawfully at large and believe they are present.
What is Section 9 of SASA?
Power to stop a vehicle to arrest a person if you suspect that person is unlawfully at large or suspect they have committed an imprisonable offence and believe they are in or on that vehicle
What is Section 10 of the SASA?
Once section 9 has been invoked, you may require any person in or on the vehicle that you suspect is unlawfully at large or suspect they committed an imprisonable offence to provide their name, address, DOB and other contact details. You can also search the vehicle for that person if you believe that person is in or on the vehicle. You may also search the vehicle for evidential material in relation to the offence the vehicle was stopped under, if they have been arrested or is seen fleeing from the vehicle.
What is Section 14 of the SASA?
If you suspect an offence is being committed or about to be committed that is likely to cause injury or serious damage or serious loss of property or there is a risk to life of anyone, you may enter a place or vehicle and take any action you believe is reasonable to prevent the above.
What is section 18 of the SASA?
If you suspect that a person is carrying arms, or is in possession of them or has them under their control AND suspect that they are in breach of the arms act or may kill or cause bodily injury to any person or there is or are grounds for a protection order or a PSO you may search the person, search anything in their possession or under their control, enter a place or vehicle to carry out a search, seize and detain any arms and licences.
You may also enter, and search a place or vehicle and seize any arms or licences found if you suspect a catergory 3 or 4 offence or an offence against the arms act has been or will be committed or for evidential material.
What is section 20 of the SASA?
If you believe there are drugs or precursor substances in a place or vehicle and cannot obtain a search warrant and that an offence against the MODA 1975 will be or had been committed you can enter and search anything in their place and vehicle. Must also believe CADD
What is Section 21 of the SASA?
Once section 20 has been invoked, you may search any person found in or on the place or vehicle.
What is Section 22 of the SASA?
If you believe person is in possession of drugs or precursor substances and suspect an offence against the MODA 1975 is being or will be committed you may search any person
What is Section 27 of the SASA?
If you suspect an offence against section 202A(4)(a) of the crimes act which relates to possession of knives, offensive weapons or disabling substances, you may search the person
What is section 28 of the SASA?
If you suspect a person in a vehicle or who has fled from a vehicle is committing an offence against Section 202A(4)(a) of the crimes act and suspect that the vehicle contained a knife, offensive weapon or disabling substances, you may search the vehicle if in a public place.
What is section 29 of the SASA?
You may search a vehicle if you believe stolen property is in or on it.
What is section 30 of the S and S?
A senior constable, or a Sergeant or above, which includes people acting in those positions, may authorise a road block for the purpose of arresting someone who is believed to be in or on a vehicle and is suspected to be unlawfully at large or to have committed and imprisonable offence.
You must suspect that the vehicle will travel past the road block and you must be satisfied that the safety of all road users will be ensured.
Authorisation may be made orally or in writing.
What is section 31 of the S and S?
If authorisation for a road block has been granted it may not exceed 24 hours. It can be renewed by a district court judge in writing for a single period of 24 hours.
A written record must be made by the authorising person the location of the road block, the period for which it was granted or renewed and the grounds for it.
What is section 32 of the S and S?
If a road block is implemented under section 30, you may:
- establish the road block
- stop any vehicles at or in the vicinity of the road block
- require any person who you suspect to have committed and imprisonable offence to state their NAME, ADDRESS, DOB.
- search the vehicle for the purpose of locating that person if you believe they are present.
What is Section 110 of the S and S?
Powers when exercising a search. Usually relating to use of force and making copies or taking photos.
What is Section 116 of the S and S?
If a search is being carried out, you may secure the place, vehicle or other thing being searched, exclude any person from that place or vehicle. You must state RAIN.
What is Section 118 of the S and S?
Where any search is being carried out in relation to a place or vehicle you may detain any person at the place or vehicle, or detain someone who arrives at the place or stops at or enters or tries to enter.
They may be detained for a reasonable time, being not longer than the search.
What is section 121 of the S and S?
Power to stop any vehicle for the purpose of carrying out any Warrantless search of effect a search warrant. Must state RAIN
What is Section 125 of the S and S?
Rules for searching person. Must state RAN. Also depicts other miscellaneous rules and abilities.
What is Section 127 of the S and S?
If a search warrant has been issued authorising the entry and search of a vehicle, the person executing the warrant may enter any place where they believe the vehicle is for the purpose of locating it and searching it.
What is Section 129 of the S and S?
Duty to provide RAIN when stopping any vehicle under the s and s.
What is Section 131 of the S and S?
A person who is executing a search power for a place or vehicle must state RAIN. other rules regarding searching and providing papers.
