A
- conditional fee agreements
- no win no fee
- agree on normal fee + success fee
- after event insurance needed - pay for cost
- if case lost, owe damages but no fee
- deductions from costs normally set at 25%

A
- no upfront payment
- no fee is loss - only damages
- widely available
- remove anxiety of costs
- offer alternative to private funding

Disadvantages of CFAs
A
- ‘cherry picking’ - only pick cases likely to win
- still owe damages - may still be unaffordable
- takes % of winnings

- very expensive - £150 p/h locally or £600-£1000 p/h London
