A

A police officer may require any person who is driving a motor vehicle on a public street to stop, and direct them to submit to a breath test, at or near the place where the requirement is made.

when does someone have the liability to Submit to a Breath Analysis

A

A driver is liable for a breath analysis or oral fluid test/collection, where a police officer reasonably believes:

Alcohol may be present in a person’s breath or blood (suspects) and reasonably believe that they drove a M/V while alcohol was so present,

Commits a MOVING OFFENCE under the Vehicle and Traffic Act / Traffic Act / Regulations (incl Road Rules), or causes death by dangerous driving* (would not test under these circumstances!!)

Vehicle is involved in a CRASH

A

The Officer in Charge of a crash scene shall take control of that scene.

Nb. The officer in charge is the first officer on the scene, until relieved by a senior member - this may not happen.

A

Warrants by telephone or other electronic means
(1) A police officer may make an application to an issuing officer for a warrant by telephone, telex, facsimile or other electronic means -
(a) in an urgent case; or
(b) if the delay that would occur if an application were made in person would frustrate the effective execution of the warrant.
(2) The issuing officer may require communication by voice to the extent that is practicable in the circumstances,
(3) An application under this section is to include all information required to be provided in an ordinary application for a warrant, but the application may, if necessary, be made before the information is sworn.
