A
A Promise made without formal consideration may be enforceable when the promisor materially changes position, and the promisee reasonably detrimentally relies on the promise and without enforcement, an injustice will occur. ADD 139 if we formed but SOF is not triggered. “Notwithstanding the SOF” it can be enforced by way of equity. (See restatement 139,90)

(iv) Causes a detriment that can only be avoided by the enforcement of a promise
