Facts:
- the claimant was given a licence to advertise on a cinema’s grounds
- when the tenants changed, claimant wanted to continue advertising, but new tenant refused
Principle:
- contractual licences are not proprietary in nature -> not binding
Decision
- Earl Loreburn: licence does not create any interest in the land -> personal and non-proprietary right
