Grantee
The person receiving the grant from”O”, or, the person to whom “O” is conveying. (Or “A”)
Grantor
The person who is conveying (granting) an interest in the land to someone else.
Testator
The estate of a person who died with a will. (Or “T”)
Successors in interest
Anyone to whom a person has given or sold the interest
Decedent
A dead person
Testate
When decedent dies with a will
Intestate
When a decedent dies without a will
Heirs
The people who inherit real property from a decedent who dies intestate (without a will). (Living people have no heirs, only heirs apparent)
Ex. Person’s spouse and children. If neither, grandchildren, parents, siblings, or other relatives.
Devise
To pass real property by will.
Ex. Martin Crowe devised his property to his stepson.
Devisee
The person receiving the property
Difference between devisees and heirs
- devisees are beneficiaries under a will
- heirs inherit property not disposed of by a will
Bequeath
To pass personal property by will.
Ex. A decedent who dies testate bequeaths his/her personal property to those named in the will.
Bequest
The property itself is called this.
Issue
A person’s lineal descendants all the way down the line. (To the point where the biological line dies out) includes children, grandchildren, great-grandchildren, etc.
