All employees are entitled to night shift differential pay except the following:

1. Government employees including those employed in government-owned or controlled corporations.
2. Employees of retail and service establishment regularly employing not more than 5 workers.
   3.Domestic helpers
3. Persons in the personal service of another
4. Managerial employees
5. Officers and members of managerial staff
6. Field personnel and other employees whose time and performance are unsupervised by the employer.
7. Workers who are engaged on task or contract basis, purely commission basis, or those who are paid with a fixed amount for performing work irrespective of the time consumed in the performance thereof.
8. Members of the family of the employer who are dependent upon him for support.
