Which adjudications CANNOT be considered decree?
As per Section 2(2)
-Appealable orders u/o 43
-Any orders of dismissal (for default)
When portions of imm.prop. situate within the jurisdiction of different courts?
u/s 17
Any one of them.
When area/local limits of two or more courts’ jurisdiction is uncertain..
SECTION - 18
Any one of them will-
➡️record statement to that effect
➡️entertain the suit.
Suit for Compensation for wrongs to person or movables
Section 19
Suit to be instituted
-where wrong was done. Or
-where defendent R,C,P
Other suits involving 2 or more defendants
SECTION 20
Suits to be Instituted where:
1) -all of defendants R,C,P, or
-any of the defendants R,C,P (upon court’s leave or non-R,C,P defendants’ acquiescence)
Or 2) Cause of action arises
Allowing objections to jurisdiction
SECTION 21
Objection shall not be allowed in the appellate/revisional court unless
1) objection is taken:
- at the EPO, or
- before settlement (if issues are
settled at)
AND
2) failure of justice happens
