Outline the powers of an enforcement inspector when investigating a breach of section 2 of the HASAWA 1974

A

Can enter work premise at any reasonable time, they must/will adhere to any H&S requirements of the premises. They are trained to support HSE regulatory work, they main aim is to give advice information & guidance

Work premises can include homes of homeworkers
They can visit for H&S inspection, and after accident in workplace to investigate.

They seek to

  • investigate cause of the accident
  • Give advice on actions to take to prevent recurrence
  • determine if there has been a breach of H&S law

Actions they can take are

  • carry of examinations & investigation, e.g measurements photos and samples
  • Take possession of an article arranging for it to be dismantled or tested
  • Seizing & make safe any article or substance that could cause serious personal injury
  • interview, request information,take statements from people that could help the investigation
  • inspect and request copys of any documents that could help with investigation

if inspector consider a breach of H&S law has occurred they can

  • issue an informal warning, verbal or in writing
  • issue an improvement notice
  • issue an prohibition notice
  • prosecute company and/or individuals

  • Top managers support committee , so employees will understand the commitment
  • top management should encourage all other members involvement in H&S discussions
