(Truthfulness or accuracy, about being honest. How true or real someone is).
Defendant’s statements are subject to specific rules, list some of them.
- Admissibility, only if they are voluntarily given. Coerced, threatened, or induced statements are generally excluded to prevent unfairness.
- Reliability: Judge may exclude the statement if there is doubt of how reliable it is. e.g, drunk, unconscious, confused.
- Defendants’ rights/cautioning: They must be informed that they are able to consult with a lawyer before making a statement.
Improperly obtained evidence (S.30)
- Obtained in breach of rights (not cautioned defendant before statement obtained)
- Involves unlawful, unfair or unreasonable actions by Police or investigators.
- Admissibility test, Determine if the evidence was improperly obtained, assess whether the exclusion of evidence is proportionate to the impropriety.
- How serious was the misconduct, public interest, cause harm to the justice system and public confidence.
Explain the Admissibility test
- was the evidence improperly obtained?
- For example, searching a house without a warrant, threaten someone into giving a statement.
- Should the evidence be excluded or allowed? (balancing)
-The wrongdoing: how serious was the mistake/rule breaking when the evidence was obtained.
-The importance of the evidence: is it very important to the case? would excluding it hurt public safety?
