right to request 1 person known to S is informed of their arrest
when can the right to legal advice be delayed?
Can be delayed if:
o D has been arrested for an indictable offence;
o Delay is authorised by a superintendent; and
o There are reasonable grounds to suspect S might:
Interfere with evidence;
Harm another;
Inform another S not yet arrested; or
Hinder recovery of property
in what form can denial be given?
oral permission allowed but must be followed up in writing as soon as practicable
how long can this right be denied for?
can be delayed for max. 36 hrs from the ‘relevant time’, which is the earlier of:
o Arrival at the station; or
o 24 hours after arrest
