when can the right to legal advice be delayed?

A

Can be delayed if:
o D has been arrested for an indictable offence;
o Delay is authorised by a superintendent; and
o There are reasonable grounds to suspect S might:
 Interfere with evidence;
 Harm another;
 Inform another S not yet arrested; or
 Hinder recovery of property

A

oral permission allowed but must be followed up in writing as soon as practicable
