What road speeds can you stop a vehicle on
<40mph
≥40mph –> need Traffic Officer
What kind of officer can lawfully stop a vehicle
Uniformed officer
What departments are in Roads Transport & Policing Command (RTPC)
RTPC - specialist command dedicated to transport safety & denying criminals use of road
Departments:
- Safer Transport Team - Patrol bus network (are being disbanded)
- Roads Policing Team - Deal w/ fast road issues (Traffic Officers)
- Serious Collision Unit - Detectives take investigation going forward
- Commercial Vehicle Unit - e.g. Read tachographs on heavy goods vehicles
- Road Crime Team - Proactive officers, targeted crime prevention initiatives e.g. against moped robberies
What is Vision Zero 2041
- Met agreed to work w/ TFL to eliminated road traffic deaths in LDN by 2041
- Part of this strategy is for RTPC to target most dangerous drivers on road in LDN
Power of police to stop vehicles?
S163 Road Traffic Act 1988 - Power of Police to stop vehicles
1) Person driving mechanically propelled vehicle on road must stop vehicle on being required to do so by uniform constable/traffic officer
2) Person riding cycle on road must stop cycle on being required to do so by uniform constable/traffic officer
3) If person fals to comply w/ this section = guilty of an offence
What must you do when using a power to stop a vehicle
- Create a CAD
- Give reason to person why you have stopped them
- Tell them what power you’re using
RTPC priorities

- Speeding - S89 Road Traffic Regulation Act 1984
- Drink/Drug Drive - S4-6 Road Traffic Act (RTA) 1988
- Driving w/o seat belt - S14 RTA
- No insurance - S143 RTA
- Use of Mobile Devices - Regulation 110 of Road vehicles (Construction & Use) Regulations 1986
What is Notice of Intended Prosecutions (NIP)
NIP - warning for a driver that they might be subject to prosecution for driving offence
- Another team will then decide if & how this person should be dealt with upon receival of a TOR
- Driver then receives post notification of decision
Format of NIP that must be given at roadside
‘I am reporting you for the question to be considered of prosecuting you for the offence of [insert traffic offence(s)]…’
- This can be read off TOR
Then driver must be cautioned using NOW caution
What caution must you use when giving a NIP
NOW caution ‘…But it may harm your defence if you do not mention now something which you later rely on in court’
(also use NOW caution when someone is being charged)
How can NIPs be recieved?
- At roadside verbally from police officer
- For offences where police do not deal w/ driver at time (e.g. roadside camera speeding offences), NIP must be sent by post within 14 days
Following reporting a person to Met Prosecutions (MO10), what are the potential outcomes?
- Driver awareness course
- Fixed Penalty Notice
- Summons to Court
- NFA
- Vehicle Defect Rectification Scheme (VDRS) - for low level defects e.g. cracked window affecting view, tire tread, broken lights
Vehicle Defect Rectification Scheme (VDRS)
- For minor defects (not dangerous condition/driving offences)
- Use form 4531
- Driver must consent
- Driver has 14 days to fix defect
- Driver must get repair confirmed by MOT testing station
- Once garage stamped form, dricer submits copy to MO10
- If completed & verified form received = no prosecution (basically a way to not criminalise a person as long as they get it fixed)
- If no form received –> MO10 consider issuing summons to court / PCR
PCR - postal charge & requisition - charged via post instead of requiring them to return to police station for charging decision
What are endorsable offences?
Endorsable offences - result in points on your diving licence (more serious offences)
- Each endorsable offence has associated point system depending on severity of offending
- List of endorsable & non-endorsable offences found on forms 4740 & 4741 on intranet
What is a ‘totting up’ ban
- Driver received 12 points on licence in 4 years
- New drivers can have licence revoked if they accumulate 6 points within 2 years of passing test
- May not give 6 points if driver already has 6 points & adding another 6 takes them over 12 point max –> would have to go to court
TOR statement format
Use descriptive language
- ‘I saw..’
- ‘I heard..’
- ‘I stopped..’
- ‘Upon examination, I found..’
