General Presumption

A

California is a community property state. All property acquired during the marriage is presumed to be community property (CP). All property acquired before the marriage, after divorce or permanent separation, or by gift or devise is presumed to be separate property (SP). Upon divorce, community assets are divided equally, unless an agreement says otherwise. Separate property remains with the individual spouse.

Quasi-Community Property (QCP)

A

Property that was acquired in a non-CP state that would be considered CP had it been acquired while the living in California. Treated as SP during marriage and treated as CP upon divorce or permanent separation.
