What is an SVRO?
It’s a civil order made in respect of an offender aged 18 or over who is convicted of an offence involving a bladed article or offensive weapon
Define “offender”
An offender is an individual, 18 or over, in respect of whom an SVRO has been made or in respect whom an application for an SVRO has been made.
Define “bladed article” and what section of the criminal justice act?
A bladed article is any article which has a blade or is sharply pointed except a folding pocketknife (unless the cutting edge of the blade of the folding pocket knife exceeds 3 inches) - section 139 of the criminal justice act.
Define “offensive weapon” and what section of the prevention of crime act is this?
An offensive weapon is any article made or adapted for causing injury to the person, or intended by the person having it with them for such use by them (or by some other person) - section 1 (4) of the prevention of crime act 1953.
Define “public place”
A public place is any place to which the public or any section of the public has access, as of right or by virtue of express or implied permission, or any other place to which people have ready access but which is not a dwelling.
What act were SVRO’s introduced?
Police, crime, sentencing and courts (PCSC) act 2022.
How long can a SVRO be fixed for?
Anytime between 6 months to 2 years, the court can determine that this won’t take effect until they are released from custody.
Who issues an SVRO?
This is issued by the courts only.
When is an SVRO issued by the court?
1 If the offender used it had with them a bladed article or offensive weapon at the time of the offence.
OR
2 If a bladed article or weapon of offence was used or possessed by another person and the offender knew, or ought to have known.
Is an offender required to disclose if they have an SVRO in place?
Yes. This should be briefed and found through intelligence systems.
What is a SVRO application/MG5 form?
Police can apply to CPS for an SVRO for an offender.
