Sixth Amendment Rule

A

6A right to counsel is offense-specific and cannot be invoked for all future prosecutions. It does not attach until formal charges and attaches during critical stages. When police deliberately elicit incriminating statements from the defendant, in absence of counsel, his 6A rights have been violated. Deliberate elicitation occurs when the police or their informant took some action beyond merely listening.
