What is an explanation of Section 9 and 10 of the search and surveillances act

A

Section 9: If I have RGTS a person is unlawfully at large OR committed and imprisionable offence and RGTB the person is in or on a vehicle so can:

Stop the vehicle without a warrant to arrest the person.

Section 10: if I am exercising S9 I can require any person in the vehicle to give me their details if they are UAL or have committed offence imprisonable.

I can also search the vehicle for the person AND search the vehicle for evidential material.

I can keep the vehicle stopped for as long as reasonably necessary for executing any powers that relate to the vehicle or occupants

I can search a vehicle if I believe grounds to conduct a warrantless search under this act.

I can also stop a vehicle to conduct a search warrant

  • I have authority to conduct a search but the location is impractical to do so
  • I have RGTB it is necessary to move the vehicle for safe keeping

Describe section 30 of the Search and Surveillance Act

A

If you have RGTS a person has committed an offence/UAL and I have RGTB they are in a vehicle
AND
I have RGTS the vehicle will travel past the road block
AND
I have RGTS the safety of road users will be upheld

I can request to a Sergeant to establish a road block to arrest

When I road block is authorised I can:

  • Establish a road block
  • Stop vehicles
  • Require any person in vehicle who I have RGTS had committed an offence to provide Name, Address, and D.O.B
  • Search the vehicle for the person who I have RGTS committed offence
