FOUR CORNERSTONES OF MODERN COPYRIGHT LAW FOUND IN THE ENGLISH STATUTE OF ANNE OF 1709:

COPYRIGHT LAW AND THE LAW ON AUTHOR’S RIGHTS:
Copyright law focuses on the actual process of making copies, whereas The Law on Author’s rights illustrates the right of the creator on his own work.
COPYRIGHT WORKS ARE CLASSIFIED INTO DIFFERENT CATEGORIES:
- Literary works
- Artistic works
- Computer program
COPYRIGHT LAW:
Copyright law has no experience in dealing with mixtures of different kinds of work or multimedia
THE DIGITISATION OF WORKS HAS THE FOLLOWING CONSEQUENCES:
- the creation of a homogenous medium of storing and transmitting works
- the merging of previously distinct classes of work into multimedia products
- difficulty in classifying multimedia products
- alteration of traditional use of copyright works by the process of digitisation and networking
WHAT IS A “COMPUTER PROGRAM”?
Computer program is a set of instructions fixed or store in any manner, and which, when used directly or indirectly in a computer, directs its operation to bring about a result.
ADAPTATION WITH REGARD TO A COMPUTER PROGRAM WAS DEFINED TO INCLUDE THE FOLLOWING:
a. a version of the program in a programming language, code or notation different from that program
b. a fixation of the programme in or on a medium different from the medium of the program.
SECTION 19(2):
section 19(1) allows for a copy of the program to be made for back-up purposes or when “intended exclusively for personal or private purposes.”
CACHING:
is the storing of copies of material from another source site, for later use when the same material is required again.
MIRROR CACHING:
is a process whereby a frequently assessed website is downloaded to another server in anticipation that the information will be required sometime in future.
PROXY CACHING:
occurs when a local area network or corporate inhouse network stores frequently used material.
s6 provides that the copyright owner has the exclusive right to do or authorise these acts:
- Reproduction
- Publication
- Public performance
- the making of an adaptation of the work
COPY IS:
Copy means the reproduction of the work
ANTI-CIRCUMVENTION:
both circumvention enabling acts and circumvention enabling devices are prohibited.
TO CIRCUMVENT A TECHNOLOGICAL MEASURE MEANS:
to unscramble the scrambled work, without the authority of the copyright owner.
