In re Ameriquest Mortgage Co.

A

Woman got a mortgage and used someone to get an appraisal. Thought it was too high. Brought a federal question claim under the Truth and Lending Act and a state claim. Documents and witnesses may not be similar but the damages are. However, no precedent in the state (first time rule applied to an appraiser), so court used their discretion to not hear it in federal court.

A

Pl (general counsel for a bank) uncovered unethical dealings of the bank and was then fired. Pl sued for violation of 2 fed employment laws & 4 Puerto Rico constitutional claims. Though facts seem to arise out of termination, novel issue for Puerto Rico and state claims are substantially predominant. No sup j.
