A
  • Vietnam war vet
  • Killed someone
  • For 10 yrs-> had nightmares, slept with a gun under his pillow, very irritable, no alcohol
  • Doctor records of PTSD
  • Wife needs a break-> goes to her brother’s house
  • Charles shows up-> brother slams the door after telling Charles to leave
    = Triggers flashback state for Charles and he shoots and kill the brother
    -> Got NCRMD because of the evidence of PSTD-> M’N: 1. Disease of mind= PTSD
    2. Didn’t understand quality of
    act= Flashback state

R.v Lavallée Case (1990)

  • Angelique Lavallee has been in a common-law relationship w Rust for a few years
  • Rust is physically abusive
  • Big party at their place where Rust accuses Lavallee of flirting w another man
  • Rust starts abusing her in front of the party, which all leave
  • She hides in a closet
  • Threatens her w a gun
  • Hands her the gun and then laughs about it
  • Lavallee kills Rust
    -> Originally charged w 2nd degree murder, but acquitted on self-defense
