Customs Appeal
The Act by which a person who is directly affected by a decision, act or omission of the Customs Authority and who considers himself to be aggrieved seeks redress before a competent authority
Cargo
Includes all goods imported, exported or carried coast-wise in any aircraft or vessel other than such Goods as are required as stores for the consumption or use for the aircraft or vessel, its crew and passengers, and the Bonafide personal baggage of such passengers
Commission
The Customs appeal Commission
Comptroller
The Comptroller of Customs or any other public officer acting on his behalf or under his authority; has the authority to run the Customs Administration
Carriage coastwise
The shipment of goods within the country’s Customs borders
Airway bill
The documentation used for aircraft cargo
Bill of Laden
The documentation used for boat cargo
Personal effects
All new or used articles which a traveler May reasonably require for his personal use during the journey; can be dutiable
Processing operations
Working of goods, processing of goods, destruction of goods, repair of goods or the use of production accessories
Production accessories
Goods which are not to be found in the processed products but which allow or facilitate the production of those products
Prohibited Goods
Goods which are prohibited by or under this act or any other law of the Commonwealth of the Bahamas
Prohibited or restricted Goods
Goods of a class or description of which the importation, exportation or Carriage coastwise is prohibited or restricted under this act
IPR/ intellectual property rights
The legal rights given to the inventor or creator to protect his invention or creation for a certain period of time
Proper officer
A customs officer who by instruction of the Comptroller exercises or perform studies according to the ACT
Refund
The repayment by the Customs authority of any amount paid as a Duty where such an amount is found to be in excess of the Duty due or payable, where goods are of faulty manufacture or where Goods have been abandoned to the crown for disposal prior to their release from the control
Refund cost
If you want to apply for a refund due to a processing error there is a fee of $70
Right holder
A natural or legal person under the laws of the Bahamas as the owner of protected intellectual or industrial property rights together in title or people authorized to sell and distribute Goods
Risk management
The systematic identification of risk and the implementation of all measures necessary for limiting exposure to risk
Risk management team
Intervene when there is smuggling or something illegal going on
Rules of origin
Customs Authority must determine the origin of goods for Customs purposes
Small craft
A vessel less than 50 tons burden
Stores for consumption
Goods taken aboard a vessel intended to be consumed by passengers and crew or needed for the operation and maintenance of the vessel i.e fuel and lubricants
Stores to be taken away
Goods for sale to passengers and crew of a vessel which are either on board upon arrival or taking on board during the stay in the Customs territory and are used in international travel
Sufferance Wharf
Any other place other than an approved place of loading and unloading that has been given the all clear by the Comptroller to allow any good to be loaded or unloaded
