A
  • Specific property to go to specific taker but disposed of prior to death
  • Gral Rule: taker does not get anything
  • Some states allow for taker to get $ from traceable funds OR equivalent property OR residue of estate

  • Few states require the residue of the estate to absorb an equitable portion of encumbrance

  • When beneficiary dies before the testator and the devise was specifically conditioned upon the beneficiary surviving
  • Gral rule: property added to residue of the estate of the testator and doesn’t go to named beneficiaries heirs.
  • Many states now have anti-lapse statute
