What are the 3 defences?

A

1) That he had in law a right to deprive the other of it on behalf of himself or a third party. = e.g. someone taking it to return it to its owner
2) That if the person who the property belongs knew of the appropriation and the circumstances of it, that the person would consent. = they believe the person would have said they could have taken it
3) The person that the property belongs to cannot be discovered by taking reasonable steps = someone who finds money on the street

Two part dishonesty test

A

1) If by ordinary standards of reasonable and honest people, what was done was dishonest.
2) Then did the accused realise that reasonable and honest people would regard it as dishonest.
