Purpose of s114
Request or signal a driver of a vehicle to stop as soon as practicable using
D- duty to be in uniform, hat and badge
A- all vehicle included
M- may request or signal driver to stop for up to 15mins to obtain ID
P- plain clothed officers may use siren and lights
D-display flashing blue+red lights and sound siren
A-arrest w/o warrant if person fails/refuses/gives false or misleading details
D- demand name/address/dog/ owner of the vehicle
Purpose of s113
Demand details from passengers or other people
D- direct person to give name/dob/address/identities of driver or owner
I- inspect or examine vehicle
M-move or authorise another person to move the vehicle causing an obstruction or hazard
D- direct person to move vehicle of in interest of public safety
O-order an unlicensed driver not to drive
D- direct a pedestrian or driver of a vehicle to stop or proceed in a particular line of traffic or direction
Purpose of s115
Green sticker- if you believe on reasonable grounds that the vehicle fails to comply with regulations or rules
Pink sticker- if you believe on reasonable grounds that a vehicle on a road is not in a condition to be driven on a road
Purpose of s121
Taking keys and forbidding to drive-
A) because of mental or physical condition
B) is not complying with driving hours
F- forbid the person to drive for a specified time
A- all keys to be surrendered
R-render the vehicle immobile
M-move vehicle causing hazard or obstruction
E-Eba offenders must be forbidden for 12hrs
D- direct the person to drive to a specified place of rest
Purpose of s118
An enforcement officer may require the owner/hirer of a vehicle to give within 14 days all information which may lead to the identification and apprehension of a driver or passenger.
Can require owner of a vehicle used to flee a police pursuit to immediately give all information available to them that would lead to the identification and or apprehension of the driver
Purpose of s95
Suspend for 28days:
1) breath over 650
2) blood over 130
3) breath over 400 and relevant within 4yrs
4) blood over 80 and relevant within 4yrs
5) failed or refused blood under 72 or 73
6) over 40kmph in a permanent zone
7) over 50kmph in another than permanent zone
Purpose of s90
Suspend licence and disqualify from driving a person whom NZTA has failed to locate and has 100 demerits. Suspension begins immediately
Purpose of s96
Seizing and impounding for 28 days
1) disqualified from holding or obtaining licence
2) suspended or revoked licence
3) forbidden/expired/unlicensed
4) breath over 400 and relevant within 4yrs
5) blood over 80 and relevant within 4yrs
6) failed or refused blood under section 72 or 73
Seize and impound for 28 days boy racers
1) operated the vehicle in a race or in an unnecessary exhibition of speed or acceleration
2) without reasonable excuse operated the vehicle on a road in a manner that caused the vehicle to undergo sustained loss of traction
Purpose of s122 and 123
Seize for 12hrs in the interest of public safety or for;
1) preserve evidence
2) enable scientific information
3) establish the cause of a serious traffic accident
Purpose of s119
Entering premises and seizing vehicles if you are freshly pursuing a person.
