Four types of people who may lack mental capacity?
-Dementia
-A severe learning disability
-mental health issues
- a stroke
What does the mental capacity act help you do?
-Support in making own decisions.
- Should not be treated as unable to make own decisions.
-Presume everyone over age of 16 has capacity
Key aspects of mental capacity act?
-Best interests- decisions made for individuals should be in their best interest.
-Least restrictive- Any decisions made on behalf of the individual should be less restrictive of their basic right and freedoms.
- Advanced care planning
Human rights key aspects?
-Everyone deserves the right to not be discriminated again.
-Right to life.
-right to liberty and security.
-right to freedom of expression.
Why are human rights important?
Ensures people are treated with dignity.
It makes sure nobody is discriminated against.
Makes them feel valued and safe.
5 values of human rights act?
-Fairness
-Respect
-Equality
-Autonomy
-Dignity
Examples where human rights act could be used?
-Schools celebrating different cultures by trying foods, crafts and festivals.
- Patients given choice of treatment.
- We can not isolate people in work places for being different.
How local authorities should act regarding;
-Carry out carers assessments and needs assessments.
-Determine who is eligible for support.
-Charge for residential and community care.
What is an advocate?
Someone who speaks on behalf of an individual who is unable to speak for themselves.
Who needs an advocate?
-Young children
-Someone with Alzheimers/Dementia.
-Someone with a learning or physical disability.
What does the children act do?
-Aims to protect children at risk of harm and keeps them safe.
- Support to children whose parents are seperating.
-Helps parents balance work and family life.
What is SEND?
-A holistic way with EHC plans.
-Rights to personal budgets for children with an EHC plan.
-Young people must be informed by local authority the support which they are entitled to.
What does Family courts and justice do?
-Introduced a 26 week deadline for family court to rule on care proceedings.
-Introduced a single order called a “child arrangements order” to replace contact and residence orders.
Health and social acts aims?
-To enable patients to have more control over the care they receive.
-Those responsible for patients can have freedom a power to commission care to meet certain needs.
Data protection act?
-Kept for that is necessary.
-Adequate and relevant but not excessive.
-Secure
-Processed fairly and lawfully.
What makes the data protection important?
-Good protection which keeps people safe.
-Promotes trust
-prevents fraud and cyber crimes.
-prevents harm,theft and discrimination
