Civil law
legal relationships between people and the protection of a person’s rights
Torts
wrongful acts that do not involve contracts - when a person is harmed due to a healthcare provider does not meet standards of care
Criminal law
the wrongs against a person, property, or society - practicing without a license
Malpractice
a healthcare professional not using a degree of skill resulting in injury, loss, or damage to the person receiving care (bad practice)
Negligence
failure to give care that is expected of a person, resulting in injury to another person
Assault
a threat or attempt to injure
Battery
the unlawful touching of another person without consent
Informed consent
permission granted voluntarily by a person, all risks haven been explained in terms the patient can understand
Invasion of privacy
revealing personal information about an individual without that person’s consent
False imprisonment
restraining an individual or restricting an individual’s freedom
Abuse
any care that results in physical harm, pain, or mental anguish - physical, verbal, psychological, sexual abuse

false statements either cause a person to be ridiculed or damage person’s reputation

a person’s wishes about receiving medical care if that person is no longer able to make medical decisions because of serious illness or injury

When a party fails to meet a contractual obligation
Implied Consent
individuals are consenting to submit to such testing when asked to do so

someone to make medical decisions for you

a way for medical staff to keep records of a patient’s health status and procedures provided by a hospital
