Q

If an HIV+ client discloses intent to have unprotected sex with someone, the therapist has a duty to warn that individual.

A

False. Social workers are required to maintain the confidentiality of HIV+ clients in regard to their sexual behavior.

There is some variance in reporting rules state to state, so if there is an answer option directing you to follow state laws, go with that. This does not fall under our duty to warn regulations because adults enter into sexual relationships assuming some level of risk and there’s no guarantee you could prevent disease transmission even if you did notify the partner. For the purposes of the national exam, this is the where you would try to work with the client to be honest with their partner(s) and if they absolutely refused, you’d need to follow your state laws to determine next steps according to individual state regulations.
