A victim is defined as… in the VRA2002

A
  • A person against who an offence is committed by another person
  • suffers emotional, or physical injury, or loss of, or damage to their property.
  • A parent/legal guardian of a child of the above, unless they are the offender.
  • A member of the immediate family, if someone dies or is incapable as a result of an offence.
  • A person who has experienced domestic violence
  • or a CYP residing with a person who has experienced domestic violence.

Section 29 VRA2002

A

Labels the specific offences that determines if a victim can go on the VNR.
Police must determine if the offence comes under Section 29 as soon as possible. The VNR notifies the victim about the bail, release, escape and death of the offender accused.

What is the role of a Court Victim Advisor (CVA)?

A

A CVA will assist victims throughout the proceedings through the court.
A Court Service for Victims Referral (CSV1) form must be handed to the CVA, alongside a Summary of Facts, on or before the defendants first court appearance.
