Section 7 VRA2002
Be treated with courtesy and compassion; and respect the victims dignity and privacy.
Section 8 VRA2002
A victim must have access to the services they require as a result of an offence. These include welfare, health, counselling, medical and legal needs.
Section 11 VRA2002
Attending parties must inform victims of the services that are available to them.
Section 12 VRA2002
The prosecuting authority must advise the victims of the -
- progress of the investigation
- charges filed or actions taken
- date and place of proceedings
- role of the victim as a witness
- outcome of the proceedings
Section 51 VRA2002
The return of property (other than the offenders) when it is no longer required.
A victim is defined as… in the VRA2002
- A person against who an offence is committed by another person
- suffers emotional, or physical injury, or loss of, or damage to their property.
- A parent/legal guardian of a child of the above, unless they are the offender.
- A member of the immediate family, if someone dies or is incapable as a result of an offence.
- A person who has experienced domestic violence
- or a CYP residing with a person who has experienced domestic violence.
Section 29 VRA2002
Labels the specific offences that determines if a victim can go on the VNR.
Police must determine if the offence comes under Section 29 as soon as possible. The VNR notifies the victim about the bail, release, escape and death of the offender accused.
What is the Victims Contact Node (VCN)?
The VCN is in NIA. Each time contact is made with the victim it needs to be noted in here.
What is the role of a Court Victim Advisor (CVA)?
A CVA will assist victims throughout the proceedings through the court.
A Court Service for Victims Referral (CSV1) form must be handed to the CVA, alongside a Summary of Facts, on or before the defendants first court appearance.
What is POL1065?
POL1065 is the form used to place a victim on the VNR.
