What are parenting orders?

A

Orders granted against…

  • one OR both biological parents
  • fathers who are not married to the mother
  • guardians (those deemed to have care of the child at the time)

  • for a period NOT EXCEEDING 12 months

Terms can include to attend counselling or guidance for a concurrent period NOT EXCEEDING 3 months AND NOT MORE than once in a week

What is binding over a parent?

A

Where an offender aged under 18 is convicted of an offence, with the parents consent they can bind the parent or guardian to conditions to provide proper care and control over the child

If they refuse to consent they can be fined no more than £1000

The binding can last up to 3 years or to when the child turns 18, whichever is lower.

If a child has a youth offender rehabilitation order imposed as part of their sentence the judge can put a condition that the parent must ensure the child abides by the order

What is the power to remove truants or excluded pupils?

A

If an officer finds a child in a public place and they have reasonable cause to believe that child is of school age and absent from school unlawfully, they can remove them to a designated premises or their school. If the child is of school age and are currently expelled for a fix period or permanently, they can remove them to a designated premises

  • unlawfully means other than sickness, unavoidable cause or day set apart for religious observation
