What is the ZZ Case?
Landmark ruling concerning the procedural rights of EU citizens facing exclusion from Member States on grounds of national security.
What is the background of the case?
ZZ was a dual French and Algerian national who had permanent residence in the UK after marrying a British woman. This made him an EU citizen with free movement rights.
What was the issue of the ZZ case?
ZZ was refused re-entry into the UK after returning from Algeria. The Secretary of State cancelled his right of residence due to his presence not being conducive to the public good.
What was ZZ’s challenge?
He appealed the decision at the UK’s Special Immigration Appeals Commission. It was then referred to the CJEU.
