What is intellectual property?
An intangible asset created by businesses through the use of skills and knowledge of their employees.
What are examples of protection of intellectual properties?
- Copyrights
- Design rights
- Trademarks
- Registered designs
- Patents
What is a copy right?
- Legal right that protects the use of your work once your idea has been officially expressed. Protection is automatic.
- Lays out a framework of rules of how the work can be used.
- Sets out the rights of the owner and responsibilities of other people who want to use the work.
What is the current copyright legislation?
Copyright Designs and Patents Acts 1998
What can you do with your copyright work?
- Copy, change or sell it.
- Share online or rent to someone and prevent others from doing the same.
How long does a copyright last for?
25 years - layout of published editions of written works
50 years - broadcasts
70 years - Written, dramatic, musical and artistic work (from authors death).
- Sound and music recordings (from when first published).
- Films (from death of director, screenplay author or composer).
What is a design right?
Automatic protection given to an objects design which lasts until earlier or 15 years from creation date or 10 years from when it was sold. Only applies to shape and configuration of objects.
What is a trademark?
A sign capable of distinguishing the goods or services of one enterprise to others. It must be unique.
What do trademarks apply to?
- Words
- Sounds
- Logos
- Colours
- Combination of all the above.
How long does a trademark last for?
10 years once granted.
What is a registered design?
- Stops people copying the design of a product and lasts 25 years once granted.
What does a registered design apply to?
- Appearance, shape and configuration
What is a patent?
Exclusive right granted for an invention which is a product or process that provides a new way of doing something or new technical solution to a problem. This must be applied for and lasts 20 years once granted.
What are the main IP related offences?
- Unauthorised use of trademark under the Trade Mark Act 1984.
- Making or dealing in copyrighted material under Copyright, Design and Patents Act 1988.
- Unauthorised copying of registered designs under Registered Design Act 1949.
- Fraud by false representation under Fraud Act - claiming their product to be one product when it’s another.
