Passive breath test.
- PASS or FAIL

Breath screening test.
- Over 400
- Over 250
- PASS

Require to accompany/detain B.O.R.

Evidential breath test.
- Under 250 : GO HOME
- 251-400 : ION
- 401+ : COURT

Blood (10 to 12 minutes)

Nurse or doctor take bloods.

These rights will continue throughout the breath and alcohol testing procedures. If you wish to speak to a lawyer a telephone will be made available to you for that purpose as soon as practicable. You will be allowed a reasonable time to consult and instruct a lawyer from the timer telephone is made available to you.

What are the correct hospital procedures for driver has been involved in a crash regarding a blood sample?

A

Medical aid is the first priority.

You cannot require a person who is in hospital, ambulance or doctor surgery as a result of an accident involving a motor vehicle to undergo a breath screening test.

You can have a blood sample taken from the person. The power for this is section 73. This sample can be taken by medical practitioner.
