Parties to offences.

What are the elements for section 66(1)?

(Deals with two or more persons who actually commit an offence by assisting in someway. Their assistance means they become parties to the offence.

A
  1. Actually commit the offences, or
  2. Does or a map selected to any person to commit the offence, or
  3. Abets any person in the commission of an offence, or
  4. Insights, councils or procurers a person to commit the offence.

What are the elements for section 66(2)?

Deals with two or more persons forming a common intention to commit an offence. Each will be guilty of an offence committed by the other in certain circumstances.

A
  1. Each of them is a party to every offence committed by any one of them in the prosecution of the common purpose,
  2. If the commission of the offence was known to be probable consequence of the prosecution of the common purpose.
