When do the acts apply
to patients over 16 years of age who will not be admitted voluntarily. Patients under the influence of alcohol and/or drugs are specifically excluded
How long is Section 2 for
Allows for admission for mental health assessment and treatment for up to 28 days, non-renewable
Who do you need to put a pt under section 2
two doctors, one of whom must be ‘approved’ under Section 12(2) of the MHA
How long is Section 3 for
Permits admission for treatment lasting up to 6 months, with the provision for renewal
Who do you need to do a Section 3
Mandates the involvement of an AMHP and two doctors, both of whom should have examined the patient within the last 24 hours
How long is Section 4 for
The patient can be detained for a maximum of 72 hours, typically followed by a transition to Section 2
Who can do a Section 4
It’s an emergency one where a section 2 would take too long
Only need 1 doctor and either a AMHP or a family relative
What is a Section 5(2)
Holding power which enables a doctor to legally detain a voluntary patient in the hospital for a period of 72 hours
What is a Section 5(4)
Section 5(4) is comparable to a Section 5(2) but is enacted by registered nurses and has a duration of 6 hours
What is a Section 135
A court order letting police go into a pts house and take them to a place of safety
What is a Section 136
Lets police take a pt who seems to be suffering from a MH illness from a public place to a place of safety
