A

-Gov agency who administrate civil and criminal legal aid
-make sure legal aid services provided by solicitors and barristers and non profit sector provided for the public

How is funding assessed for civil cases?

A

-Means test: D’s income and capital and partners will be considered together unless partner is victim. Income means tested. If have benefits then auto pass. Need to prove they don’t have enough to provide own lawyer
-Disposable income: is gross income below certain amount per month then need to calculate disposable, start with gross and take away necessities (tax NI childcare etc)if amount left below certain level then don’t have to pay, if above wont qualify, if between then pay monthly contribution
-Disposable capital: assets of a person, eg money in bank, savings, stocks and charges. To get funding max limit is £8000. Even if below can be asked to pay contribution. Only first £100000 of any mortgage taken from the value.

A

-Interests of justice - any matter in proceedings deciding against, lose liberty, livelihood or suffer damage, considerable POL, can’t understand proceedings, cross examination etc
-factors considered eg prev conviction, nature of offence, risk of custody, if d guilty more serious = more likely to qualify

A

motor insurance policies, cover to help with legal fees in case for road accident. House insurance for any claims for visitor being injured on premises
-policies just for insurance against legal costs (before event)
-more common after event where insure against having to pay other side

A

-Anyone who can afford it can pay for own solicitor or barrister.
-firms in towns, sol specialise
-can be £150 per hr, bigger firms £600 or £1000

A

-Solicitor ad client agreed on fee normally charged for case, also what success fee will be
-if client lose then pay nothing or half.
-success fee could be up to 100% of normal fee, most have a cap preventing more than 25%

A

-Citizens advice bureaux: charitable organisation, volunteers, face to face interviews, expertise in debt advice, housing, welfare and employment. Agreements with local firms who agreed to provide cheap help
-Charities: shelter, give advice to those with housing problems
-Trade union: free legal advice on employment issues, pay subscription, full time specialists, negotiate with employer, PI specialist sol provided
-Pro bono unit: volunteer barristers. Free advice to those who can’t afford to pay
-law centres: free non means tested advice, rep offered where not many solicitors available, only 41, funded by local gov, part time solicitors
