What are the 5 aims are there of sentencing Adult offenders?
Punishment
Public protection
Rehabilitation and reform
Reparation
Reduction of crime
What is punishment?
Punishment is based off “an eye for an eye”. Judge makes sure the sentence is equal to the crime. Most severe example is mandatory life custodial sentence for murder.
What is public protection?
Where the public needs to be protected from dangerous offenders. If court believe public are at risk then a custodial sentence must be given otherwise methods such as the Home Detention Curfew Order (ankle tag) can be used.
What is rehabilitation and reform?
A method to try and reform the offenders with hope that the penalty given will change their behaviour. A forward-looking aim.
What are reparations?
They are a method where the offenders are must pay compensation to the victims or return stolen items to the victims (restitution).
What is reduction of crime?
A method the court uses by using sentencing to try and reduce the levels of crime. E.G: Rehabilitation and reform. Reduction by deterrence is a method used where courts use sentences to deter offenders from offending again. E.G: Suspended custodial sentences.
