What is the most serious sentence for the most serious crimes called?
A custodial sentence (imprisonment).
When is a mandatory life sentence given?
In murder trials.
What is the difference between a “whole life order” and a mandatory life sentence?
A “whole life order” means the offenders will never be released from prison (currently 75 people). A mandatory life sentence is where the judge can set a minimum amount of years the offender must serve before they have the chance for release.
What is the max punishment for a discretionary life sentence?
Life in prison. The judge does not have to impose this.
What is an extended determinate sentence?
A combination of a 12 month minimal custodial sentence and an extended period ”on licence” where the offender can live in the community with certain conditions. E.G: Keep in regular contact with the police
What is a suspended sentence?
Where the offender will only go to jail if they commit an offence within a particular time frame.
What is a fixed term sentence?
Where the judge can only give a custodial sentence up to a specific length. E.G: Assault is 6 Months MAX.
What is a home detention curfew?
Where the offender is ordered to stay at home during certain times, up to 16 hours a day. Monitored with an electronic tag (ankle tag).
What is a non-custodial sentence?
A sentence that does not involve imprisonment.
An adult may be given a ____ which may include 1 or more of 14 available requirements.
Community order.
What is a compensation order?
A fine to be payed to the victim.
What is the least severe sentence?
A discharge. It can be absolute where no further action will be taken. It can be conditional where further action is taken if the offender re-offends.
