What is considered a Level 1 use of Force or Level 1 type of Injury?

A
  1. Hand/Foot Strike
  2. Forcible takedown
  3. Wrestling subject to ground
  4. OC Spray
  5. Taser in cartridge mode (Lt or above must Investigatin Supv. Discharges by ESU my be handled by a Sergeant)
  6. Mesh restraining blanket

Type of Injury at Level 1
A. Physical Injury (minore swelling, laceration without stitches, abrasion, comp of pain)
B. Alleged excessive Level 1 Force (from above 1-6) with no injury. (Typically made by civilian witnesses or subjects)

Investigating Supv will by Immediate Supv (one rank above subj officer)

TRI Worksheet only prepared

Note: Ordering a subject to lay on the ground in a controlled manner, drawing your firearm, using Velcro restraint straps, or using polycarbonate shield to restrain someone is not considered a reportable use of force in this procedure.

In situations where a person alleges force used against them but MOS claims no force was used, or no member can be identified, immediate supv of mos will Prepare Part A of TRI Worksheet.

What is considered a Level 2 use of Force or Level 2 type of Injury?

A
  1. Intentional striking subject with an Object (Impact weapon)
  2. Police Dog bite
  3. Taser in drive stun mode (CO/DC must respond and conduct investigation)

Level 2 type of Injury
A. Substantial Physical Injury (Significant contusion, Lacerations with sutures, or any injury or condition resulting from police contact or action requiring Treatment at a hospital ER)
B. Alleged/Suspected excessive force with physical or substantial physical injury.
C. Attempted Suicide by Prisoner

Investigating Supv must be CO/XO/DC (must respond)

TRI worksheet and Supv Assessment Report prepared.

Note: Minore redness or comp of pain resulting from the Proper use of handcuffs does not constitute PI, nor does comp of pain resulting from drug withdrawal or previous medical condition.

Injury/illness sustained by a subject prior to police action requiring transport and treatment at a hospital ER is not SPI for this procedure

Routine washing of subject eyes from OC spray or removal of Taser darts and routine exam at ER is not considered SPI for this procedure.

  • No Taser on rear handcuffed subject
  • No force used to prevent a subject from swallowing contraband or removing it from his/her mouth or body cavity.

When you have varying levels of force and varying levels of injury, always go with the higest for investigating purposes. So if someone does a handstrike (Level 1) and breaks someones nose (Level 3) then IAB would investigate bc of Level 3 injury.

What is considered a Level 3 use of Force or Level 3 type of Injury?

A

Deadly Physical Force- physical force readily capable of causing death or SPI

Type of Level 3 injury or illness
A. Broken/Fractured bone
B. Injury or condition resulting from police contact/action which results in a Hospital Admission.
C. Gunshot Wound
D. Heart attack, stroke, or life threatening injury/illness.

IAB must respond to the scene.

Who will investigate Taser discharge use of force?

A

If Taser used in Cartridge mode, the IS must be a Lt or above.

If Taser used in Drive Stun mode, the IS must be CO/XO/DC, unless superseded by IAB or Force Investigation

What are the proper steps when a UMOS discharges a firearm on or off duty?

A

UMOS

  1. Call for ambulance and render assistance to injured, if necessary.
  2. Request Patrol Supervisor, pct of occur, and safeguard scene.
    * If discharge occurs outside NYC, notify local authorities and Operations, either personally or by responsible messenger.

Patrol Supervisor
1. Respond and assume command
2. Assess if members sustained injuries.
Serious injury= nearest Trauma Center
Minor injury = nearest Hospital, after conferring with CO/DC (tinnitus)
3. Establish Crime Scene.
4. Secure and inspect firearms for evidence of recent discharges
5. Notify DO (request PDS
6. Perform duties of Immediate Supv as per 221-03

Desk Officer
1. Notify ICOBS without waiting for details.
    IAB
    CO/XO
    Operations
    Boro
    Squad

Note: Firearms discharge into safety stations only requires 49 for CO to Police Academy, FTS.
FID member will transport involved firearm to Firearms Analysis Section.

What are the steps to follow when a person dies or sustains a Serious Injury and is likely to die in police custody or from police action?

A

Police In-custody death or person likely to die includes:
A. Police force or restraint may be a factor in death
B. Suicide (prisoner commits suicide inside holding cell)
C. Accidental (drug OD, reaction to medicine)
D. Apparent natural causes (heart failure, asthma attack, other natural cause)

UMOS

  1. Obtain medical attention
  2. Safeguard crime scene
  3. Request Patrol Supv, pct of occur

  1. Respond and assess situation
  2. Safeguard crime scene
  3. Notify Desk Officer

Force Investigation Division is responsible for all investigations when a person dies or likely to die while in police custody, or immediately prior to police custody.

How will a UMOS administer the OC Spray?

A

Pepper spray into subject’s eyes using 2, one second bursts, at minimum 3 feet away, 2 1 3, when person actively resisting. Can spray dangerous animal also.

Do not use OC Spray on subjects who passively resist (going limp, no physical resistance. IF POSSIBLE (May use) avoid using OC Spray on:
PREY CD (you can spray the frail, pregnant and children but only if they are actively aggressive. Not just active resistance)

Pregnant
Respiratory conditions
Elderly
Young Children

Confined areas
Disorder control situations (can use if specially trained and with permission of authorized supervisor)

Who will assume the role of Incident Commander during an Active Shooter situation?

A

Second Supervisor on Scene will be IC

1st Supv

  1. Confirm thru radio all units responding (ESU, HNT, SRG…)
  2. Request CO/DC respond
  3. Tactically enter with other UMOS, or regroup, and advance toward shooter

2nd Supv
A. Assume role of I.C.
B. Establish and secure a Cold Zone with I.C. Post within Cold Zone
C. Keep DO and Operations apprised of situation

Note: If they give active shooter scenario on test day, do not wait to isolate and contain. Enter and make contact with the shooter to stop killings. If they say its a hostage situation, or that perp is barricaded and not shooting, then isolate and contain.

Off-Duty mos should refrain from entering active shooter scenarios unless loss of life is imminent.

When will an EDP be taken into custody?

A

Armed or Violent= Do not attempt to take into custody without supv permission unless there’s immediate threat of physical harm to EDP or others present

Unarmed/Non-Violent/Refuses to leave= Isolate and contain

Unarmed/Non-violent/Willing to leave= UMOS can take into custody

Zone of Safety= Minimum distance of 20 feet recommended.

  1. Establish firearms control
  2. Deploy protective devices

Note: Highest ranking uniformed Police Supervisor at the scene will coordinate police operations. If EDP is contained and believed to be armed or violent and poses no immediate threat, no action will be taken without authorization for CO/DC at the scene.

How will Canine units be used?

A
  1. Only use canine to search a building for a perp when there are no non-suspects in the building.
  2. Tactical use of canine for other than the 10 listed things, need permission for the Boro Commander
  3. For non-peaceful demo you need approval from Chief of Patrol

When will a Threat, Resistance, or Injury Report be prepared?

A

A. a subject, or any non-MOS, sustains a Physical Injury or dies as a result of a police action or while in custody.
B. a MOS sustains a Physical Injury, or dies, as a result of apprehending, or attempting to apprehend, a subject or control an individual or individuals.
C. a prisoner Attempts or Commits suicide.
D. Any level of force, as described in 221-03, is used by an MOS, whether or not an injury is sustained.
E. Any level of force, as described in 221-03, is Alleged or Suspected, whether or not an injury is sustained.
F. Force, against MOS (HARM in 221-06) is used against MOS, regardless of whether or not an injury is sustained.
G. A MOS discharges OC spray, Taser or Firearm, regardless of of whether or not an injury was caused. (Includes accidental discharges, discharges against an animal)

Each incident gets One TRI Number regardless of how many MOS or number or subjects or civilians involved.
