What are the presumptions of the suspect for the Crime Control Model?
It is presumed the suspect is guilty, and that the police’s evidence is always correct.
There’s an emphasis on punishing offenders.
What are the presumptions of the suspect for the Due Process Model?
It is presumed the suspect is innocent, which upholds their rights to a fair trial.
What does the Due Process Model think is the biggest threat to society and how does it deal with it?
The biggest threat to society is state oppression, which is restricted via PACE (1973)
What does the Crime Control Model think is the biggest threat to society and how does it deal with it?
The biggest threat is crime, being best dealt with by having the CJS be like a conveyor belt.
What is the Due Process Model compared to?
An obstacle course as it is slow and takes its time bringing justice to ensure it is fair.
What is the Crime Control Model compared to?
A conveyor-belt as it focuses on dealing with offenders as quickly as possible.
Does the Crime Control Model expect police evidence to be correct, and why?
Yes, as it has belief the police’s evidence will be reliable. This leads to the defendant being presumed guilty before trial.
Does the Due Process Model expect police evidence to be correct, and why?
No, as the defendant is innocent until proven guilty.
