Actus Reus Generally
The voluntary, prohibited act the prosecution must prove the defendant committed
MPC 2.01 Actus Reus Requirement
- A person is not guilty of an offense unless there is a voluntary act or the omission to perform an act which he is physically capable
Said omission must be sufficient by law defining the offense or a duty to perform the omitted act is imposed by law
MPC Not voluntary acts
- A reflex or convulsion
- a bodily movement during unconsciousness or sleep
- conduct during hypnosis or resulting from hypnotic suggestion
- a bodily movement that is not a product of the effort or determination of the actor,
either conscious or habitual
MPC actus reus for possession
possession is an act if the possessor knowingly procured OR received the thing possessed OR was aware of his control thereof for a sufficient period to have been able to terminate his possession.

Omission to Act generally
There is no general duty to act, certain instances creates a duty to act
Omission to Act Analysis
Determine a legal duty
Determine capacity to perform the duty
Determine willful neglect or refusal to preform duty
Determine if harm was a direct consequence of the failure to perform duty
Common Law duties to Act (also apply to the MPC)
- A statute creates a duty to care for another
- One has a status relationship that creates a duty (parent/child, teacher/student, Spouse/spouse)
- One assumed a contractual duty to care for another
- One has voluntarily assumed the care of another AND secluded the helpless person as to prevent others from rendering aid
- One has a duty to care for another when they the one creates the peril
TPC Injury to Elderly or Disabled Person
A person commits the offense if they INTENTIONALLY, KNOWINGLY, RECKLESSLY, OR with CRIMINAL NEGLIGENCE by act OR INTENTIONALLY, KNOWINGLY, OR RECKLESS by omission causes to a child, elderly or disabled individual serious bodily injury OR serious mental deficiency, impairment, or injury OR Bodily injury.
Omission is a conduct for this offense if the actor has a legal or statutory duty to act OR the actor has assumed care, custody, or control of a child elderly or disabled individual.
