What qualities are included in the definition of ‘Good Moral Character’ for bar admission?
Honesty, fairness, candor, trustworthiness, observance of fiduciary responsibility, respect for and obedience to the law, and respect for the rights of others and the judicial process.
What does the Moral Character Evaluation process involve?
Background checks including criminal records and employment history; fingerprinting; explanations for inconsistencies (e.g., reasons for leaving jobs).
Why is candor crucial in the bar admission process?
Because dishonesty can be worse than the original issue. Expunged convictions may need to be disclosed—always read the application carefully.
Do you need to disclose disabilities or mental health conditions in your bar application?
Only if specifically asked. There is no duty to volunteer this information; bar no longer inquires about mental health status.
What are the types of discipline a lawyer may face?
Disbarment, suspension, public reprimand, private reprimand.
What are grounds for discipline in the legal profession?
Criminal conduct or violations of professional responsibility. Includes moral turpitude, such as dishonesty or violence.
Can a lawyer be disciplined for misconduct outside legal practice?
Yes, if the conduct shows unfitness to practice law (e.g., DUI, assault).
Can a lawyer be disciplined for representing disreputable clients?
No, but they must not aid the client’s misconduct.
