What do the first three amendments guarantee?
Individual freedoms
Amendment 2
Gives people the right to bear arms. Arms are weapons or guns.
Amendment 3
It outlaws quartering, or housing, of soldiers in private houses.
Amendment 4
Protects the people from the police or government invading your house or arresting you at any time. It outlaws any unreasonable searches and seizures. Must have a search warrant to search your home.
Search warrant
A document issued by a judge to the sheriff for the purpose of getting evidence concerning a crime.
Arrest warrant
A document issued by a judge to the sheriff with the purpose of arresting someone suspected of a crime.
Amendment 5
Gives Americans many basic legal protections. One cannot be charged for serious crime without an indictment by a grand jury. Protects against double jeopardy and self-incrimination. Guarantees the right of due process of law.
Grand jury
A group of people who decide if there is enough evidence to have a trial.
Indictment
A formal charge, or accusation, against a person
Double jeopardy
When a person is tried twice for the same crime. The government cannot punish a person twice for one crime.
Self-incrimination
When a person has to witness against themselves. Government protects people from having to do this.
Due process of law
Whatever the government does, it cannot take away someone’s life, liberty, or property without first going through the proper steps set fourth in our laws.
Amendment 6
We are guaranteed the right to a fast, fair, and public trial. People accused for a crime have the right to be present in court and have a lawyer represent them, even if they can’t afford one. It basically protects the rights of the accused.
Amendment 7
Guarantees Americans the right to a trial by a jury in any case involving more than $20. Or, it is also our right to decide on having only a judge deciding a case instead of a jury.
Amendment 8
Protects us from having to pay excessive bail or be punished in a cruel or unusual ways.
Jury
A group of twelve peers who decide the case
Bail
Money that is given in order to be released from jail.
Amendment 9
Etcetera amendment: under this other rights not listed in the Constitution are also given to the people. Protects all rights not listed.
Amendment 10
Gives all powers not specifically listed in the Constitution to the states and it’s people.
