who can make the application and how?
the PR can make the application personally or it can be made through a solicitor
a solicitor must apply online if the application is straightforward
in all other cases (inc. where PR is making the application personally), the application can be made by post or online
what are the relevant forms and when should they be used?
PA1P (there is a Will) + PA1A (there is not a Will)
what should a solicitor always check before applying?
that the Will is valid
what does the statement of truth in the application form inc.?
Confirms PRs will administer the estate in accordance with the law + applicant is truthful
what must be inc. with PA1P?
Information about any Wills/codicils must be included on PA1P + the original documents must be lodged with the application
if there is doubt as to the validity of the Will, evidence in support of validity (if available) should be encloses
what must the applicant do if the Will/codicil is lost/missing?
The applicant will need to make an application for an order (+ w/s or affidavit) for an order admitting to proof of the document
A copy of the Will should be inc. if possible
