how long does a PR hold office for?
PR remains a PR for life unless the grant is revoked
how can a PR retire?
PR cannot retire once they have taken GOR. They would need to apply to the court for the grant to be revoked.
can a PR be substitued/removed?
The court has the power to:
o Remove a PR and appoint a substitute PR; and/or
o If there are two or more PRs, terminate an appointment
what is passing over?
The court has a wide discretion to pass over the person entitled to take GOR where it is necessary or expedient
what expenses can PRs reclaim? what are the exceptions?
PRs can only reclaim expenses incurred for executing their duties, exceptions:
o Professional PRs can receive reasonable renumeration if the other PRs agree in writing
o There is an express charging clause (this should detail what can be claimed)
