When contacted by an arresting Officer regarding releasing an arrestee to medical personnel, ensure that the arrestee is not released from custody if the following charges are applicable:

A

a. Crimes against an Officer
b. DV or DUI (Driving on a DUI revoked license) or any other charge where arrest is mandated by statute.
c. Any violent crime against person with significant injury
d. any violent crime with the use of a deadly weapon
e. Sexual Assault and/or
f. Kidnapping

Review with the Ofcr what is in the best interest of the arrestee and the Dept to allow the arrestee to be released to medical staff and either issue a citation or submit for a warrant at a later time

NCF (No Charges Filed) Procedures

A

If the arrest does not meet all the necessary requirements the charges can be released by filing NCF and must be down within 48 hours (not routinely done at City Jail), Must be NCFed prior to submission of the arrest info to the DA , if it is beyond the 48 hours the release must be coordinated with the DA Screening office 702-455-4721)

Patrol Sgt or Det Sgt will

  1. Review completed arrest reports to determine the validity of the arrest based on:
    a. P/C Probable cause for each element of the crime charged
    b. applicability of the crime charged
    c. Presence of any add’l evidence to support the allegation (charge)
