63
What are some of the current issues associated with the protection of intellectual property in South Africa? Give reference to your answer.
The current issues in South Africa associated with the protection of intellectual property include being able to prove that the idea was originally yours. For example, there is a case of a famous celebrity and a person who pitched an idea for a certain show. According to this person, they pitched their idea to this famous individual and later on this famous person ends up using this idea. The person, later on, claimed that the idea was originally theirs and that this famous person stole their idea. And obviously, this famous person also claims that the idea is originally theirs. One of the major issues associated with the protection of IP is actually proving that the idea is yours, and also due to South African's inequalities ordinary individuals may find it difficult to execute their ideas therefore that leads to them seeking assistance from a person who is well off, if the person decides to use the idea it may be difficult for this ordinary individual to prove that it is originally theirs and for the fact that in South Africa there more you have money, the greater powers you have, if suppose the issue goes to court an ordinary individual would obviously struggle to hire a lawyer while a person who is well off may even bribe some authorities to get away with that. Therefore in South Africa, the major issue is inequalities, the application of the laws.
